Welcome to Sendd.
Sendd is a global commerce infrastructure and payment orchestration platform designed to help merchants operate across jurisdictions while maintaining strong consumer protection, data protection, and payment compliance standards.
These Terms of Service (the “Terms”) govern your access to and use of Sendd.store, Sendd marketplaces, and all related websites, products, features, tools, APIs, and services (collectively, the “Services”).
By creating an account, accessing, or using any part of the Services, you agree to be bound by these Terms.
As used in these Terms, “Sendd,” “we,” “us,” and “our” refer to the applicable Sendd contracting party (see Section 26). “You” means the individual using the Services, or the business or organization on whose behalf the individual is acting (including affiliates).
If you do not agree to these Terms, you must not access or use the Services.

1. Definitions
- Account — A Sendd account used to access and manage the Services.
- Merchant — A business or individual using Sendd to sell, facilitate, or manage transactions.
- Customer / End-User — A buyer or visitor interacting with a Merchant using Sendd infrastructure.
- Store — Any storefront, checkout, listing, payment link, or commerce experience created using the Services.
- Materials — Content and data provided by you through the Services.
- Third-Party Services — External services integrated with Sendd (e.g., payment processors, analytics providers).
2. Scope of the Services
Sendd provides commerce infrastructure and merchant-controlled commerce tools enabling Merchants to sell or manage transactions for:
Physical goods · Digital goods · Services · Events · Subscriptions · Rentals · Pre-orders · Payment collection · Inquiry submissions · URL-based or external checkout experiences
Features may include:
- Storefront building
- Checkout and payment orchestration
- Marketing tools
- Analytics
- Shipping workflows
- Marketplace participation
- Integrations
Not all features are available in all locations. Sendd may modify or discontinue features at any time.
3. Account Eligibility and Registration
You represent and warrant that:
- You are at least 18 years old or legal age of majority
- You have authority to bind your business
- You are using Services for business or commercial purposes
Sendd may reject or suspend accounts subject to applicable law.
4. Account Security and Communications
You are responsible for:
- All activity under your Account
- Protecting credentials
- Monitoring your primary email
5. Store Ownership and Transparency
You must clearly display:
- Legal or trading business name
- Public contact method
- Refund / return policy (if applicable)
- Fulfillment timelines and disclosures
Public Store Visibility
Content you publish may be publicly visible and indexed by search engines.
6. Payments, Providers, and Merchant of Record
Payment Providers
Payments may require third-party providers (e.g., Stripe). These operate under their own terms.
You are responsible for:
- Payment account setup
- Chargebacks and disputes
- Tax obligations
- Compliance requirements
Merchant of Record
Unless explicitly stated otherwise in writing, Sendd is not the seller or merchant of record.
Sendd provides infrastructure only.
7. Merchant Responsibilities
You are solely responsible for:
- Products and services sold
- Pricing and disclosures
- Consumer law compliance
- Customer support and refunds
- Fraud risk management
No Merchant Verification
Sendd does not guarantee the legitimacy, safety, or quality of merchants, products, or services unless explicitly stated.
Customer Disputes
Disputes between Merchants and Customers are the Merchant’s responsibility except where required by law.
8. Fees, Billing, and Taxes
You agree to pay all applicable fees including platform, transaction, and feature fees.
Fees are generally non-refundable except where required by law.
You are responsible for determining and paying taxes related to your sales.
9. Acceptable Use
You must not use Services to:
- Engage in illegal or fraudulent activity
- Violate export controls or sanctions laws
- Sell illegal products
- Infringe intellectual property
- Distribute malware
- Attempt to bypass system safeguards
Sendd may suspend or remove content or accounts for violations.
10. Your Materials and Content License
You retain ownership of Materials.
You grant Sendd a worldwide license to use Materials only as necessary to operate and improve Services.
Sendd may display your store name or logo for promotional purposes.
11. Sendd Intellectual Property
Sendd owns all platform technology and software.
12. Third-Party Services
Third-party integrations operate under their own terms.
You authorize Sendd to share required data for integrations.
13. Beta Services
Beta features are provided as-is and may change or be discontinued.
14. Feedback
Feedback may be used by Sendd without restriction.
15. Intellectual Property Takedown
Sendd may remove infringing content and accept counter-notifications.
16. Privacy and Data Protection
Use of Services is subject to the Sendd Privacy Policy.
Merchants are responsible for compliance with privacy laws.
17. No Legal, Tax, or Compliance Advice
Sendd provides software and infrastructure only.
Sendd does not provide legal, tax, accounting, or regulatory advice. You are responsible for determining and complying with applicable laws.
18. Disclaimers
To the maximum extent permitted by law:
Services are provided “as is” and “as available.”
Sendd does not guarantee:
- Transaction success
- Payment authorization
- Payout timing
- Continuous availability
Sendd does not verify merchant products or quality.
19. Limitation of Liability
Sendd is not liable for indirect or consequential damages.
Total liability is limited to fees paid in the previous 3 months, unless prohibited by law.
20. Indemnification
You agree to indemnify Sendd for claims related to:
- Your store
- Your products
- Law violations
- Customer disputes
21. Confidentiality
Each party must protect confidential information.
22. Force Majeure
Sendd is not liable for failures caused by events beyond reasonable control including:
- Natural disasters
- Internet failures
- Infrastructure outages
- Government actions
- Third-party service failures
23. Suspension for Risk, Compliance, or Payment Partner Requirements
Sendd may suspend Services where required by:
- Payment processors
- Financial institutions
- Legal or regulatory obligations
- Fraud or abuse investigations
24. Changes to Services and Terms
Sendd may modify, suspend, or discontinue the Services or any part of the Services at any time.
Where changes materially affect your rights, Sendd will provide reasonable advance notice where practicable.
Sendd may make immediate changes without notice where required for:
- Legal or regulatory compliance
- Security or fraud prevention
- Payment processor, banking partner, or financial institution requirements
- Abuse prevention or platform integrity
- Risk management or safety concerns
Sendd does not guarantee the continued availability of any specific feature, integration, or functionality.
Sendd may remove or restrict Stores, Materials, or functionality where necessary to comply with law, partner requirements, or platform safety standards.
Sendd may provide Services to competitors of Merchants, provided confidential information is protected.
25. Termination
Either party may terminate Services. Access may cease and stores may be taken offline.

- Sendd, Inc. (United States)
- Sendd Limited (New Zealand)

- United States law → Sendd, Inc.
28. General Terms
